Terms of Service
These Terms of Service ("Terms") are an agreement between you and Postigent ("Postigent", "we", "us", "our") and govern your use of the Postigent website and application (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.
1. The Service
Postigent lets you connect social media and messaging accounts ("Channels"), then create, schedule, publish and analyze content for them, and collaborate with teammates and clients. Features may change over time as we improve the Service.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You must give accurate information when you register and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account, including activity by teammates you invite. Tell us promptly at info@postigent.com if you suspect unauthorized use.
3. Connected Channels and third-party platforms
- When you connect a Channel, you authorize Postigent to access it and act on your behalf within the permissions you grant, including publishing the content you schedule.
- You must only connect accounts, pages and groups you own or are authorized to manage.
- Your use of each platform remains subject to that platform's own terms and policies (for example Meta, X, LinkedIn, TikTok, Google/YouTube, Pinterest, Discord and Telegram). You are responsible for complying with them. Where you connect YouTube, you agree to the YouTube Terms of Service.
- Platforms control their own APIs and may change, limit or withdraw access at any time. We are not responsible for a platform's actions, outages, rate limits, fees or decisions about your account or content, and some features may stop working as a result.
4. Your content
- You keep all rights to the content you create, upload or publish through the Service ("Your Content").
- You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example resizing images to meet a platform's format) and transmit Your Content, solely to operate and provide the Service to you, including publishing it to the Channels you select.
- You are responsible for Your Content and confirm you have all rights and permissions needed to publish it, and that it does not infringe anyone's rights or break any law or platform rule.
5. Acceptable use
You agree not to use the Service to:
- publish spam, misleading or deceptive content, or run coordinated inauthentic behavior or fake engagement;
- publish content that is illegal, infringes intellectual property, or is defamatory, harassing, hateful, sexually exploitative or violent;
- impersonate any person or organization, or misrepresent your affiliation;
- violate the terms or policies of any connected platform;
- access or try to access accounts, data or systems you are not authorized to use, or interfere with the security or performance of the Service;
- scrape, reverse engineer or overload the Service, or use it to build a competing hosted service in breach of these Terms;
- upload malware or any harmful code.
We may remove content or suspend access if we reasonably believe you have broken these rules.
6. Fees
The Service is currently provided free of charge. If we introduce paid plans, we will tell you the prices and terms before you are charged, and you can choose whether to subscribe.
7. Open-source software
Postigent is built on Postiz, which is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). The source code of the version of Postigent we run is available at github.com/Oladapodaniel/postigent. Nothing in these Terms limits your rights under the AGPL-3.0 for that source code. The Postigent name and logo are not licensed under the AGPL-3.0.
8. Availability and changes
We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted, error-free, or that every scheduled post will be published on time, since publishing depends on third-party platforms. We may modify, suspend or discontinue any part of the Service. Where a change materially reduces the Service, we will try to give you reasonable notice. Please keep your own copies of important content.
9. Suspension and termination
- You can stop using the Service and delete your account at any time. See our data deletion instructions.
- We may suspend or terminate your access if you breach these Terms, if required by law or a platform, or to protect the Service or other users. Where reasonable, we will notify you first.
- Sections 4 (license limited to what is needed to wind down), 10, 11, 12 and 13 survive termination.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular results, such as reach, engagement or follower growth.
11. Limitation of liability
To the fullest extent permitted by law, Postigent will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You agree to indemnify and hold Postigent harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of any platform's terms.
13. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting any formal proceedings, you agree to contact us first so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Nigeria, unless mandatory consumer protection law where you live gives you the right to bring proceedings in your local courts.
14. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date and, for material changes, notify you by email or in the Service before they take effect. If you continue using the Service after changes take effect, you accept the updated Terms.
